A petition has been filed in the Madras High Court today on behalf of MDMK general secretary Vaiko in reply to the writ petition by splinter-group led by L Ganesan and Gingee Ramachandran.
In the petition filed by MDMK's Legal Wing secretary Devadas, it was stated the 16th general council meeting of the party was held on 10 January under the Section 17(6) (A) of the party's bylaw. All the members were informed of the meeting.
Added to this, the party had placed advertisements in dailies to inform on the proposed meet. Out of the total membership of 1,416 at the general council, 1,303 members attended the meeting. During the meeting, a resolution was passed to strip presidium chairman L Ganesan and deputy general secretary Gingee Ramachandran of their posts for their anti-party activities.
However, the duo were still included in the primary membership of the party. In this connection, the party had informed the Election Commission that the two members were not removed from the MDMK, but were only relieved from their posts through a legally binding resolution at the council meet.
However, the duo had filed a writ petition in the Madras High Court complaining that they weren't given proper opportunity to explain their stand at the Council meet. General secretary Vaiko in his reply stated that the Council meeting convened by Gingee Ramachandran as deputy general secretary was illegal as he had no such power to hold such a meeting in the first place.
Referring to the duo's petition in the High Court, Vaiko made a plea that the prefix 'general secretary' mentioned for Gingee Ramachandran should be removed since it was a misleading one. When the petition came up for hearing before Justice M Thanikachalam, he adjourned the case for 7 February.
